These Terms of Service are an agreement between Driven Success LLC and the person or entity using SearchMesh. By creating an account, accessing the service, or using its API or MCP endpoint, you agree to these Terms. If you act for an organization, you represent that you can bind it.
Service and accounts
SearchMesh is a hosted gateway that authenticates requests, sends them to eligible third-party search providers, and returns normalized results and provider-status information. You must be able to form a binding contract, provide accurate account information, keep credentials secure, and promptly report suspected unauthorized access.
Your content and third-party services
You retain rights in the queries, credentials, configuration, and other content you submit. You grant us the limited right to process that content to operate, secure, and improve the service. You are responsible for having a lawful basis to submit content and for your use of any provider. Each provider has its own terms, availability, pricing, policies, and data practices. You must obtain and maintain rights to credentials you configure and must not use SearchMesh to bypass a provider's limits or terms.
Acceptable use
You may not use SearchMesh to violate law, infringe rights, distribute malware, conduct phishing or fraud, send spam, scrape or collect data contrary to applicable terms or law, interfere with the service, evade access controls, or process data where you lack authority. We may investigate misuse and suspend or terminate access where reasonably necessary to protect the service, users, providers, or others.
Availability and disclaimers
SearchMesh and third-party search results are provided on an "as is" and "as available" basis. We do not guarantee uninterrupted operation, provider availability, completeness, accuracy, ranking, or fitness for a particular purpose. You must evaluate results before relying on them.
Liability
To the maximum extent permitted by law, Driven Success LLC is not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages. Our aggregate liability arising from the service will not exceed the greater of fees you paid to us for the affected service in the twelve months before the event or USD 100. These limitations do not apply where law does not allow them.
Changes, termination, and law
We may modify or discontinue the service and may update these Terms. For material changes, we will give reasonable notice before they take effect. You may stop using the service at any time and may delete your account from the dashboard. These Terms are governed by Delaware law, excluding conflict-of-laws rules, except where mandatory law provides otherwise.
